1. Contractual Relationship

These Terms of Use govern the access or use by you, an individual, from within the Federal Republic of Nigeria.

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.

Your access and use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and KekeLink. If you do not agree to these Terms, you may not access or use the Services.

2. The Services

KekeLink is a platform that allows users of our WhatsApp bot to arrange transportation and delivery services with independent third-party providers (drivers).

Please note: KekeLink does not provide transportation or logistics services. We are not a transportation carrier. All trips are provided by independent contractors.

(a) Third-Party Services: KekeLink operates through the WhatsApp platform. By using our service, you acknowledge that you are also bound by WhatsApp's (Meta) Terms of Service and Privacy Policy. KekeLink is not responsible for the functionality or privacy practices of WhatsApp.

3. Your Use of the Service

(a) User Requirements: Users must be at least 18 years of age. You are responsible for all activity conducted through your WhatsApp account. KekeLink reserves the right to request proof of identity and to suspend service to any user who engages in prohibited or unsafe conduct.

(b) Network Access: Your mobile network's messaging and data rates apply. KekeLink isn't responsible for delays or errors caused by your internet connection or WhatsApp outages.

4. Payment

All fares consist of a base fare plus a variable amount calculated by the KekeLink bot based on the total distance in kilometers and the current market rate. You are responsible for any costs related to the repair of damage to vehicles resulting from your use of the service.

5. Disclaimers; Limitation of Liability; Indemnity

(a) Disclaimer: KekeLink services are provided on an "as is" basis. We explicitly disclaim all warranties and do not guarantee the reliability or safety of third-party drivers.

(b) Limitation of Liability: KekeLink is not responsible for any accidents, property damage, or personal losses during your ride. The maximum amount KekeLink will ever pay you for any claim is limited to ₦10,000 or a refund of your trip fare.

6. Dispute Resolution & Governing Law

(a) Governing Law: These Terms shall be exclusively governed by the laws of the Federal Republic of Nigeria.

(b) Arbitration: In the event of a dispute, both parties agree to attempt an informal resolution via KekeLink support. If unresolved within 30 days, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act of Nigeria.
